How are dividends from a Chinese company taxed?

Under the Hong Kong-China Double Taxation Arrangement (DTA), the withholding rate can be reduced to 5% if the Hong Kong tax resident is the beneficial owner and holds at least 25% of the Chinese company. What is the CIT filing frequency in China?

China CIT is filed on a quarterly provisional basis, with returns due within 15 days after the end of each quarter. An annual CIT return must be filed by May 31 of the following year. The annual filing must be accompanied by audited financial statements prepared in accordance with China Accounting Standards (CAS) or equivalent. A tax settlement (final adjustment) is performed at year-end to reconcile provisional quarterly payments with the actual annual tax liability. Any shortfall must be paid with the annual return, while overpayments can be carried forward or refunded upon application.

Can foreign tax credits be claimed against China CIT?

Yes, China allows a foreign tax credit (FTC) for income tax paid overseas on foreign-sourced income derived by Chinese resident enterprises. The credit is limited to the China CIT payable on that foreign income, calculated on either a per-country or overall limitation basis. Excess credits can be carried forward for up to 5 years.
